Under RODO, personal data refers to any information that can identify an individual directly or indirectly, such as names, addresses, email addresses, or even IP addresses. The regulation sets out several key principles that must be followed when processing personal data, including the requirement for lawful and fair processing, purpose limitation, data minimization, accuracy, storage limitation, integrity, and confidentiality.
RODO places greater accountability on organizations or data controllers who handle personal data, requiring them to obtain explicit consent from individuals before processing their data and to implement appropriate technical and organizational measures to ensure its security. It also grants individuals certain rights, such as the right to access, rectify, or erase their personal data, as well as the right to object to its processing.
Failure to comply with the provisions of RODO can result in significant penalties, including fines of up to 20 million euros or 4% of the annual global turnover, whichever is higher. The regulation aims to enhance privacy protection and data security for individuals, while also promoting a common data protection culture and facilitating the free flow of personal data within the EU.
